Though previous laws regarding sex crime penalties in California made it so those who’ve committed sex crimes would have to be placed on the sex offender registry for life, as of January 1, 2021, this is no longer the case. On this date, Senate Bill 384 was passed, which made it so certain sex offenders can have their names removed from the sex offender registry after a period of time. The system is broken down into three tiers, and they are as follows:

  • Tier One: Those who commit lower-level sex offenses will be placed in Tier One, which means that after at least 10 years, they may qualify for having their names removed from the sex offender registration list.
  • Tier Two: Mid-level sex offenses can warrant a person being placed in Tier Two, which means that after at least 20 years, they may qualify for having their names removed from the sex offender registration list.
  • Tier Three: High-level sex offenders are placed in Tier Three. Those in Tier Three may remain on the sex offender registry for life. That said, you should note that a Tier Three designation is based on a Risk Assessment, and at times, this can warrant only a 20-year registration requirement.
